Welcome to nyceville.

By accessing or using the nyceville mobile application and related services (collectively, the "App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and nyceville Ltd. Co. ("nyceville," "we," "us," or "our"). If you do not agree to these Terms, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 17 years of age, you may only use the App with the consent and supervision of a parent or legal guardian. By using the App, you represent that you meet these age requirements.

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Purpose of the App

nyceville is a community-oriented platform designed to support families raising children with special needs. The App enables users to share experiences, ask questions, and connect with other families. Content provided through the App is for informational and support purposes only and is not intended to replace professional, medical, legal, or educational advice.

3. User Accounts

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to keep it updated.

You must notify us immediately at if you believe your account has been compromised.

4. User-Generated Content

Users may post content, including questions, answers, comments, votes, group posts, care log entries, and messages ("User Content"). You retain ownership of your User Content. By submitting User Content through the App, you grant nyceville a non-exclusive, worldwide, royalty-free license to display, distribute, and store the content within the platform as necessary to operate and provide the App's services.

When a user deletes their account, their answers to community questions may be retained in anonymized form (with authorship changed to "parent") to preserve community knowledge. This anonymized content cannot be linked back to your identity.

nyceville reserves the right to remove User Content that violates these Terms, our community guidelines, or is deemed harmful, inappropriate, or unsafe.

5. Community Guidelines

nyceville is built on mutual respect and support. When using the App, you agree to:

Treat other users with respect, empathy, and good faith.

Share information honestly and responsibly.

Respect the privacy of other families and their children.

Report content or behavior that violates community standards.

6. No Professional Advice

nyceville does not provide medical, legal, therapeutic, educational, or any other professional advice. Content shared by users represents personal experiences and opinions. Always seek guidance from qualified professionals regarding your specific situation. nyceville is not responsible for any decisions you make based on information shared within the App.

7. Acceptable Use

You agree not to misuse the App. Prohibited activities include, but are not limited to:

Harassment, bullying, threats, or abuse directed at any user.

Impersonation of any person or entity.

Posting content that is illegal, defamatory, obscene, or harmful.

Attempting to access accounts, data, or systems that do not belong to you.

Using the App for commercial solicitation, spam, or advertising without prior written consent.

Uploading malicious code, viruses, or any content designed to disrupt the App.

Collecting or harvesting personal information from other users.

Circumventing or attempting to circumvent any security features of the App.

8. Intellectual Property

The App, including its design, features, branding, logos, and original content, is the property of nyceville Ltd. Co. and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

"nyceville" and related branding are trademarks of nyceville Ltd. Co. You may not use our trademarks without prior written permission.

9. Privacy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Account Suspension and Termination

nyceville may suspend or terminate your account, with or without notice, if you violate these Terms, our community guidelines, or engage in conduct that we determine is harmful to other users or the community. We reserve the right to take appropriate action, including content removal, warnings, temporary suspension, or permanent ban.

You may request deletion of your account at any time through the App or by contacting us at . Upon deletion, your personal information will be removed in accordance with our Privacy Policy.

11. Third-Party Services and Links

The App may contain links to third-party websites, services, or resources (such as advocacy contacts, support organizations, or external tools). These links are provided for convenience only. nyceville does not control and is not responsible for the content, privacy practices, or availability of any third-party services.

12. Disclaimer of Warranties

The App and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. nyceville does not warrant that the App will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, nyceville Ltd. Co., its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App, whether based on warranty, contract, tort, or any other legal theory.

nyceville is not liable for any damages arising from reliance on user-generated content, interactions between users, or third-party services linked within the App.

14. Indemnification

You agree to indemnify, defend, and hold harmless nyceville Ltd. Co., its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the App, your User Content, or your violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the App shall be resolved in the state or federal courts located in the State of Georgia.

16. Changes to These Terms

We may update these Terms from time to time as the platform evolves. If we make material changes, we will notify you through the App or by other appropriate means. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and nyceville regarding your use of the App and supersede any prior agreements.
